My First Game Making Class Day 1


The first day was pretty good eventhough everything I pretty much planned fell apart; this is kind of a theme in South Korea as far as teaching goes: from technical issues, to some damage on my desktop due to transportation, to schedluing issues... the list just keeps going on. However, we went over the basics of the internet and answered all of the questions I wanted them to answer, and used the movie the "Social Network" as an example of how HTML CSS and Javascript work.



After looking at three clone tutorials (astriods, pac-man, and breakout) students decided to make a pacman clone.  So I created the character above based on their feed back.

I'm going to continue to develop the art from the list above since we have no real artists. Also, with the scheduling concerns, I hope my class is not cancled today; if it is, I'll have to email the the C2 file, and countinue working on the game with the students online. This of course will be a pain becuase they are teenage boys with other things to do this summer.

Today we will be talking about gameplay and game art...

Five Issues for Potential Final Project for BUL FS Class

Five Issues for the Outline


1.) Misrepresentation

Definition of Term:
Stated facts that are not true and may include guarantees that are unfulfilled.

Why:
My fear is when I’m creating initial agreements or drafts of agreements that the language is off which could create confusion on terms of an agreement that may create a unintentional misrepresentation.

Title of Case

PACRIM ASSOCIATES v. TURNER HOME ENTERTAINMENT INC

Brief Summary:
This 1998 case deals with an agreement that has international aspects as far as production and distribution. Pacrim believed that they had an official agreement with Turrner Home Entertainment (THE) that made Pacrim THE’s exclusive licensing and merchandising agent in Thailand for a year; Pacrim accused them of “breach of contract, promissory estoppel, and fraud, inter alia” because of an early termination. The court of appeals reversed charges against Pacrim and affirmed the court’s decision that THE did commit Fraud.


2.) Financial Liability
Question for Instructor: Couldn’t find a good case but need help with this one: I want to deal with Korean Investment potentially to raise funds for an event, what cases should I look into?

Definition of Term:
In this case, how other people’s money is handled related to investing in third party companies.

Explain and Why:
Handling investments both domestic and foreign may actually become a reality. Already have been in contact with a CPA to handle domestic taxes, but need more information in drafting agreements.

Brief Summary:

In this case, Applet Court affirmed decision because Migal wanted a “exploratory action” to further their case after evidence was inclusive during trial; however, the court decided that their was no grounds because it would violate other jurisdictions to do so. Thus, the court affirmed the court’s decision.

3.) Trademark Infringement
My concerns relate to the fact we are currently using natural trademark laws and the DMCA (DMCA) to establish a brand and web presence before forming an LLC later this year.

Explain and Why:
Web Presence/Advertisement concerns relate to this case. Meaning, when we put out our brand and IPs, can someone claim infringement based on how similar the design by happen-stance may be.

Definition of Term:
Trademark is a protective mark that helps consumer identify one brand from another. An infringement can include anything that causes confusion for a consumer or market place between brands.

Brief Summary:
In this case, “Natural Answers” is accusing “Smithkline Beeham” of Trademark Infringement over the Internet. Ultimately, the ruling stands that since Natural Answers was using a natural trademark and was not currently doing business, Smithkline Beeham was not infringing on a trademark and can make claim because Natural Answers had not registered a Trademark or was currently doing any current business online.


3.) Product Liability

Definition of Term:
Product liability is when a party is responsible for any incidents or accidents that may be related to the design or development of a product in a market place.

Explain and Why:
We deal with a 12 to 40 year old demographic potentially, so we are not necessarily worried about the classic “Warning Children Under 3: Choking Hazard” found on a lot toy packages. However, even though it may cause branding issues, we are at least going to put some type of warning; the question is “what?”.

Brief Summary:

In 1994, after an autopsy, it was revealed that the suction cup dart lodged in the right bronchus and blocked air in his throat, which caused the child to choke to death. During the Trial, Division Sale violated a “limine” agreement causing the jury to blame the boy’s family and causing the jury to side with Division Sales; thus, The plaintiffs were given another trial based on the “limline” violation.

5.) Wrongful Interference


Definition of Term:
Wrongful Interference means to get in the way of two party’s business agreements or purposely cause a break between business agreements. In this case, Slander may have been used to cause a deal to not happen or continue.

Explain and Why:
Oh my god, that’s all I have to say. Seeing and having some deals at conferences, I see a whole lot of tort cases ready to happen. Even the nature of the Internet is not friendly to Wrongful Interference. Until reading this case, I wasn’t interested in “Slander” as a reason to file a civil case in relation to the tort “Wrongful Interference.”

Brief Summary:
Snyder accuses a representative of Sony Music of slander, which caused Snyder to loose contacts and business agreements. Slander was hard to prove; moreover, multiple violations of the firm’s policies were on record. Snyder tried to cross appeal, but his arguments were viewed as “academic” not “factual”, so the court denied his appeals and he lost.

My Coverage of APE 2010



APE 2010, the first convention I did, I learned was more about selling prints, tee shirts, buttons, etc, and less about selling a small independent comic. If you had posters, people were more likely interested. However, even a pretty poster with eye-catching colors didn’t mean sales. A fabulous award-winning artist had a hard time making the final sale even though many onlookers came to visit the artist who had frequented the convention many times the past three years. From my observation and conversations, by Sunday, many in state creators did make profit, but a lot of out of state creators were lucky to break even.

A big reason to do APE is to join the point system for the other conferences of Comi-Con International. The point system leads to better positioning and a chance to get in the over pact San Diego comic-con. In California, San Diego Comi-con remians the best conference to sell original work after accounting for the massive markups and costs during the convention. Wonder-con also in San Francisco is also part of Comic-Con International.

None the less, APE 2010 according to many professional posts on Webcomics.com’s “Convention Dish” has been a more shirking market for comics in general. My onsite observations also had a startling revelation this Saturday, where were all the kids or teens? The demographic for APE did not lead itself to many different types of age groups.

On aside note, although inexpensive alternatives such as Comic Xpress are good for many creators, often creators will choose to print in places like china to lower their overhead and maximize their sales. Nonetheless, This sill means spending a lot money with little guarantee of sales in a year. Often creators have to sit on product for years until they sell out.

Other conventions to consider, Emerald City in Seattle Washington and STAPLE in Austin Texas, which seems to becoming another Emerald City Con, have more attendees hungry for product. Emerald City as a convention is a perfect example of a small comic convention that slowly grows over time because there is enough of a market for comic-books in that town.

In state, there are other conventions such Long Beach Con. In the Bay Area Zine Fest seems to be a great spot to sell alternative comics, but once an event develops a good name for itself, it becomes harder to get in if there are sales to be made. Thus APE, in relationship to Wonder-Con and San Diego Comi-Con, is a good conference to start to get into the swing of things, because it is a convention it gets you in larger convention. However, the lack luster sales for many artists who flew in to do APE often give these creators negative sales and negative attitudes about the show.


Unfortunately, aside from networking and meeting many wonderful artists, I did not sell many of my and my writer’s books. In this sense, if we had more eye catching swag, we could have sold more products; however, we wanted to focus on creating and telling a good story. In this sense, before we even consider to start-making t-shirts, we have to stick to the core product that is the pre-teen to adult graphic novel we intended to create. Still, I’m going to work on my ability to create high contrasting eye catching prints for other events where our project may be more appreciated such as Zine Fest or other local events.
